The recently proposed amendments to the Federal Rules of Civil Procedure have generated a lot of optimism that the unreasonable costs and burdens associated with discovery can finally be addressed. However, without a corresponding change in discovery culture by courts, counsel, and clients alike, the proposed rules modifications will likely have little to no effect on the manner in which discovery is conducted today. This presentation will detail the key steps that in-house lawyers can take to change the discovery culture of their organizational clients and the likely impact this will have on the discovery process.
