AbstractThe author provides a primer on the intricacies involved in bringing a securities fraud case to trial. He begins with an overview of the federal securities laws and the current climate of securities litigation. Most importantly, the author provides insight on how to sustain a complaint brought under the Private Securities Litigation Reform Act of 1995. He also examines the difficulty in preserving genuine issues for trial under summary judgment attacks. Finally, the author explains how to use "traditional" trial techniques such as voir dire, the opening and closing arguments, and witness impeachment in a complex area of the law.
