Abstract

Simply because a court has the authority to do something does not, standing alone, warrant that it act. Appellate judges in Alabama are apparently flirting with the idea of adopting "objective" standards for assessing or measuring pain - a phenomenon that the authors argue is incapable of objective assessment or measurement.
