Advanced Appellate Advocacy

The course will use three sources of materials. First, we will work primarily from the book Making Your Case by Justice Antonin Scalia and Bryan A. Garner. Second, in class we will use examples from briefs and motions made part of the public records of various Alabama courts. Finally, we will examine and critique briefs submitted to the Alabama Supreme Court in a case to be orally argued before that Court at Samford University.
The Scalia-Garner text will be available in the campus bookstore, but may be purchased elsewhere. The in-class examples will be provided to you weekly. The briefs will be provided to you when they are released by the Alabama Supreme Court.
We will also refer periodically to the Alabama Rules of Civil Procedure and the Alabama Rules of Appellate Procedure. The Rules should be available to you electronically.
Week 1 - Introduction to Legal Reasoning
August 20 Read parts 22 to 27 of the Scalia-Garner text. In class we will work on basic logical reasoning as used in legal analysis. Be prepared to work with statutory texts, caselaw, and facts to create simple, strong legal arguments.
