First Assignment

Course Materials

The course will use three texts. We will work primarily from the book Making Your Case by United States Supreme Court Justice Antonin Scalia and Bryan A. Garner. We will use the Scalia-Garner text to focus on principles of legal reasoning. We will also use two texts to focus on the mechanics of excellent writing: The Elements of Style by William Strunk, Jr., and E.B. White, and Plain English for Lawyers by Richard C. Wydick. I will also provide you with examples from briefs and motions made part of the public records of various Alabama courts.

These texts will be available in the campus bookstore, but may be purchased elsewhere. The in-class examples will be provided to you weekly.

We will also refer periodically to the Alabama Rules of Civil Procedure and the Alabama Rules of Appellate  Procedure. The Rules should be available to you electronically.

Week 1 - Introduction to Legal Reasoning

August 19

Read parts 22 to 27 of the Scalia-Garner text. We will work on basic logical reasoning as used in legal analysis. Be prepared to work with statutory texts, caselaw, and facts to create simple, strong legal arguments.

Read chapter 1 of the Wydick text.
